Terms of Service

1. Agreement to Terms

By accessing or using the PLUGINWORK website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of Service

PLUGINWORK provides custom printing services including but not limited to:

• Direct-to-Film (DTF) printing on apparel
• Custom t-shirts, hoodies, and other garments
• Signage and decal printing using HP Latex technology
• Custom design services
• Order fulfillment and shipping services

All products and services are subject to availability. We reserve the right to discontinue any product or service at any time.

3. User Accounts and Registration

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate your account if any information provided is inaccurate, fraudulent, or violates these Terms.

4. Messaging Services Integration

We use Chatwoot as our customer messaging platform to provide support through multiple channels including:

• Facebook Messenger
• Instagram Direct Messages
• Email
• SMS
• Website chat widget

By contacting us through any of these channels, you consent to us storing your messages, contact information, and conversation history for the purposes of providing customer support, processing orders, and improving our services. You must be at least 13 years of age to use messaging features connected to Meta platforms (Facebook Messenger and Instagram).

5. Intellectual Property and User Content

When you upload designs, artwork, or other content to our Service, you represent and warrant that:

• You own or have the necessary rights to the content
• The content does not infringe on any third-party intellectual property rights
• The content does not violate any trademark, copyright, or other proprietary rights
• The content is not defamatory, obscene, or otherwise illegal

You grant PLUGINWORK a limited, non-exclusive license to use, reproduce, and display your uploaded content solely for the purpose of fulfilling your order and providing related services. We will not sell, license, or distribute your designs to third parties without your explicit consent.

PLUGINWORK retains all rights to our website design, branding, proprietary processes, and original content. You may not copy, reproduce, or distribute any content from our Service without written permission.

6. Prohibited Uses

You agree not to use our Service to:

• Upload content that infringes on intellectual property rights of others
• Create products featuring copyrighted logos, trademarks, or characters without authorization
• Submit designs containing illegal, hateful, obscene, or discriminatory content
• Engage in fraudulent activities or impersonate others
• Violate any applicable local, provincial, national, or international laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers) to access the Service without permission

We reserve the right to refuse service, cancel orders, and terminate accounts that violate these prohibitions.

7. Orders, Pricing, and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including:

• Product unavailability
• Pricing or product description errors
• Suspected fraudulent activity
• Violation of these Terms

Prices are displayed in Canadian Dollars (CAD) and are subject to change without notice. Payment must be received in full before production begins. We accept payment via credit card, debit card, and e-transfer through our secure payment processor, Stripe.

Sales tax (HST/GST where applicable) will be calculated and added at checkout based on your shipping address.

8. Production, Proofs, and Approval

Before production begins, we will provide a digital proof showing your design placement, size, and colors. You are responsible for reviewing and approving the proof. Once you approve a proof, we proceed with production and cannot make changes to the design.

We make every effort to match colors accurately, but variations may occur due to differences between screen displays and physical printing. By approving a proof, you acknowledge and accept potential minor color variations.

If you do not respond to a proof within 7 business days, we may assume approval and proceed with production.

9. Turnaround Time and Delivery

Standard production turnaround is 3-5 business days after proof approval. Turnaround times are estimates and not guarantees. Rush orders may be available upon request and are subject to additional fees.

Shipping times vary based on carrier and destination. We are not responsible for delays caused by shipping carriers, customs, weather, or other factors beyond our control.

For local pickup orders, we will notify you when your order is ready. Pickup is available at our Markham, Ontario location during business hours: Friday 12:00 PM–4:00 PM, Sunday 10:00 AM–5:00 PM, and by appointment Tuesday-Thursday.

10. Returns, Refunds, and Cancellations

Because all products are custom-made to order, we generally cannot accept returns or offer refunds except in the following circumstances:

• Production error or defect caused by PLUGINWORK
• Incorrect product shipped (wrong size, color, design not matching approved proof)
• Damaged items received (you must notify us within 48 hours of delivery with photographic evidence)

Order cancellations are only possible before production begins. Once a proof is approved and production starts, orders cannot be canceled.

In cases where we determine a refund or reprint is warranted, we will work with you to resolve the issue promptly. Our liability is limited to the purchase price of the affected items.

11. Limitation of Liability

To the fullest extent permitted by law, PLUGINWORK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from:

• Your use or inability to use the Service
• Delays in production or shipping
• Errors in product specifications or descriptions
• Unauthorized access to your account or data
• Third-party content or conduct

Our total liability for any claim related to the Service is limited to the amount you paid for the specific product or service giving rise to the claim, or CAD $100, whichever is less.

12. Indemnification

You agree to indemnify, defend, and hold harmless PLUGINWORK, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your uploaded content infringing on third-party rights
• Your misuse of the Service
• Any dispute between you and another user

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts located in Markham, Ontario, Canada.

14. Age Restrictions

You must be at least 18 years old to make purchases through our Service. Users aged 13-17 may browse the website but must have parental or guardian consent to place orders or use messaging features connected to Meta platforms (Facebook Messenger, Instagram).

We do not knowingly collect personal information from individuals under 13 years of age. If we become aware that we have collected such information, we will take steps to delete it promptly.

15. Third-Party Services

Our Service integrates with third-party platforms and services, including:

• Stripe (payment processing)
• Chatwoot (customer messaging)
• Meta platforms (Facebook Messenger, Instagram)
• Shipping carriers (Canada Post, UPS, FedEx, etc.)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or services of these third parties.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PLUGINWORK regarding the use of the Service and supersede any prior agreements or understandings.
